Patient Abuse in Nursing Facilities Essay

Patient abuse in nursing facilities is becoming more prominent. Abuse is not only physical, but emotional, sexual, neglect and financial exploitations. The elderly are the most vulnerable and least likely to complain, so unfortunately they are the targets. Most families research in depth about the nursing facility that they will place their loved one, in hopes that abuse doesn’t occur. Although the research is done, families should still look for signs and symptoms of abuse since they are leaving their loved one in stranger’s hands. According to (Center), A recent investigation concluded that employment checks do not always provide adequate protection against elder mistreatment. For instance, the Centers for Medicare and Medicaid Services prohibit nursing homes from hiring persons with a prior history of committing abuse in a nursing home setting, but those who have been convicted of other forms of abuse like child abuse may still be hired. Some states require a criminal background check, while others do not. Even so, these checks usually do not uncover convictions in another state. Furthermore, in some states, non-caregiving staff such as maintenance workers and others without a direct patient care role do not undergo criminal checks even though they may have direct access to patients and patient areas. Understaffing is a common cause of nursing home abuse. When staff members become overworked, they may begin to lose their patience with the nursing home residents. In addition, understaffing leaves many workers unsupervised or untrained, which can lead to nursing home abuse. Still, physical abuse in nursing homes is illegal, and the owners of the assisted living facility can be held liable if a resident is subject to nursing home abuse or neglect. Sometimes, it is difficult to identify nursing home residents who have been physically abused. Very often, members of the nursing home staff will state that the resident’s injuries were the result of a fall rather than the actual cause–nursing home abuse. In addition, the staff member may bully the resident into agreeing with their story. Because detecting signs of physical nursing home abuse can be difficult, loved ones should pay careful attention when visiting the nursing home. Be aware of the common signs of physical nursing home abuse, including: unexplained bruising, cuts, sprains, fractures and broken bones and open wounds. In addition to physical signs, nursing home patients who have been physically abused may also show changes in their behavior. If the resident appears withdrawn, fearful, nervous or depressed, they may be suffering from physical nursing home abuse. The most common type of physical abuse is battery, which can include forcing the resident into restraints for no valid reason. Other forms of physical abuse in nursing homes include: overmedication, use of excessive restraints, chemical or physical, for no reason, burning, pushing, shoving, force feeding, hitting the resident with the hand or an object, pulling the resident’s hair and mishandling the resident when transporting them from beds, bathrooms etc ( (Morgan). According to (Emotional Abuse in Nursing Homes), Emotional abuse in nursing homes is not as overt as other forms of abuse. Regardless, the effects that emotional abuse in nursing homes can result in are damaging to the happiness, health, and other areas of that resident’s life. Not knowing what signs to look for can allow emotional abuse in nursing homes to continue. Often times, a resident thinks that telling someone about abuse suffered, including emotional abuse in nursing homes, will make them a burden to the family or they feel afraid of enduring an increased amount of abuse. If emotional abuse in nursing homes is occurring the family members should immediately notify the facility. The facility should amend the situation at once but if the emotional abuse in nursing homes persists, the family should take further action. The chances of the emotional abuse in nursing homes occurring to just one resident are very slim so other residents are probably suffering as well. Emotional abuse in nursing homes can include humiliation, harassment, threat of punishment, deprivation, and intimidation, as well as other behaviors. One of the most pervasive forms of nursing home abuse today is that of neglect. Nursing home neglect is too frequently overlooked and results all too often in a decline in general health and eventually the death of those elderly people entrusted to nursing home care facilities. The problem can occur anywhere and can take many shapes. What makes this particularly sinister is that it can be overlooked or ignored for so long. Even upon repeated visits to a nursing home, the signs of nursing home neglect can remain hidden. In order to understand the scope of the problem, it is important to know the different types of nursing home neglect and nursing home abuse. The most obvious, most egregious, and the first that comes to mind for many people is physical neglect. Unfortunately common in nursing homes today, neglect takes many forms, however, all of which are disturbing in their own right. Any of the following forms of neglect warrant contacting a nursing home abuse lawyer to bring justice to the victim of neglect, as well as make conditions safer for other residents (Center). According to (Financial Exploitation of Nursing Home Residents), Financial exploitation of the elderly occurs when an individual takes or uses the money or property of a senior for any wrongful use, or with the intent to defraud the elder. Senior citizens who live in nursing homes or other long-term care facilities can be victims of financial abuse by their direct caregivers or by the administrators of the nursing homes. Financial exploitation is defined as the wrongful use of an individual’s finances or property for another’s advantage. This can occur when residents’ personal or financial resources are taken from them without their consent, either because the residents were incapacitated and unable to give consent or because they were subjected to threats, intimidation, manipulation, and deception. Examples of financial exploitation include cashing an elderly person’s checks without authorization, forging a senior’s signature, stealing an older person’s money or possessions, or deceiving an older person into signing any contract, will, or other document. According to (Nursing Home Abuse), It is critical for every resident to understand their nursing home patient rights in order to successfully acclimate to the very different living environment of a skilled nursing facility. Patients and their families should become well versed in the policies and procedures inherent to life in the facility and must know exactly what they can and should expect when it comes to care and safety. In the US, the federal government and each state government have written legislation which guarantees each nursing home resident specific and general rights while under professional care. Most foreign counties have similar laws enacted to protect elders from abuse and neglect in nursing facilities, as well. When your loved one is placed in a nursing home, it is required that they are given a written bill of patient’s rights. It is recommended that the family and loved one go over this bill of rights in detail so they are familiar with the rights of their loved one. Most often, nursing home patients cannot defend themselves, due to several different reasons: physical health, mental health, social isolation or dependency issues. Unless someone comes forward for these patients, they won’t get help and no one is penalized for their actions. Many do not know how to report nursing home abuse, so they remain silent and struggle with their disturbing knowledge of the abuse or neglect. Once the repost is filed, the organization that is responsible, will investigate thoroughly and will hold the person/persons responsible for their actions. If you are a family member and suspect any minor abuse or neglect, it is always wise to report the activity to the nursing home administrator directly. Tell them that you have evidence of the abuse and that you intend to take this matter as far as it will go. Do not back down. If the infraction is minor and resulted in no real damage, then you may consider allowing them to discipline the staff member internally. Just be sure to watch out for any retribution which may come back to your loved one if the staff member is not fired. If the infraction is more serious or you do not feel completely confident that the matter will be settled in the best interest of your loved one, then take the concern one step further. Immediately call police and report the incident. Additionally, contact adult protective services, your ombudsman, your local nursing home regulatory agency and Medicare, if applicable. You might also consider consulting with a nursing home abuse attorney and filing a civil lawsuit (Nursing Home Abuse). Although abuse in nursing facilities is becoming more prominent, there are several things that family members can do to protect their loved one from being a victim from this horrible crime. The elderly are very vulnerable, but they do not deserve the abuse that the under paid, aggravated staff member may give them. If someone suspects abuse in a nursing facility, they should report it immediately. If not, this makes you just as guilty.

Behavioural Science and its Contribution to Organizational Behavior Essay

Chapter 1 Introduction: Behavioural science is the systematic analysis and investigation of human behaviour through controlled and naturalistic observation, and disciplined scientific experimentation. It attempts to accomplish legitimate, objective conclusions through rigorous formulations and observation. Behavioral sciences could be categorized into three main forms psychology, sociology and anthropology. Insights from several pure disciplines across behavioural sciences are explored by various applied disciplines and practiced in the context of everyday life and business. These applied disciplines of behavioural science include: organizational behavior, operations research, consumer behaviour and media psychology. Behavioural sciences abstract empirical data to investigate the decision processes and communication strategies within and between organisms in a social system. Scientists in this field looks at individuals and their behavior along with the behavior of societies, groups, and cultures, as well as processes that can contribute to specific behaviors. The social sciences tend to focus more on structural systems and cultures, while behavioral science tends to look at the reactions within and between organisms that dictate behavioral trends Organizational Behavior is the study of individuals and their behavior within the context of the organization in a workplace setting. It is an interdisciplinary field that includes sociology, psychology, communication and management Statement of the problem Many modern organizations are faced with numerous challenges such as illegal and unethical behaviour in a number of business transactions. Managers are also faced with the challenge of evaluating the effect of this critical behaviour on the performance of such organizations. Again, many business managers operate their activities today, without keen interest of bothering whether their actions are right or wrong and the extent of employees  understanding of the term ethics while the level of compliance is highly infinitesimal, (Oladunni 2002).The way Nigerian society cares little about the welfare of the employees tend to make some of these business operators to begin to wonder about the necessity of behavioural science in an organization. The term gained currency in the 1950s in the United States; it is often used synonymously with â€Å"social sciences,† although some writers distinguish between them. The term behavioral sciences suggests an approach that is more experimental than that connoted by the older term social sciences. Behavioral and social sciences research is a large, multifaceted field, encompassing a wide array of disciplines. The field employs a variety of methodological approaches including: surveys and questionnaires, interviews, randomized clinical trials, direct observation, physiological manipulations and recording, descriptive methods, laboratory and field experiments, standardized tests, economic a nalyses, statistical modeling, ethnography, and evaluation. Yet, behavioral and social sciences research is not restricted to a set of disciplines or methodological approaches. Instead, the field is defined by substantive areas of research that transcend disciplinary and methodological boundaries. In addition, several key cross-cutting themes characterize social and behavioral sciences research. These include: an emphasis on  theory-driven research; the search for general principles of behavioral and social functioning; the importance ascribed to a developmental, lifespan perspective; an emphasis on individual variation, and variation across sociodemographic categories such as gender, age, and sociocultural status; and a focus on both the social and biological contexts of behavior. The core areas of behavioral and social sciences research are divided into basic or fundamental research and applied research. The basic and applied research distinction serves more of an organizational function for purposes of this definition, rather than representing firm boundaries within the field. Indeed, many studies have both basic and applied components. Moreover, basic and applied research is often complementary. Basic research frequently provides the foundation for subsequent applied research, and applied research often influences the direction of basic research. Definition of â€Å"behavioral†Ã¢â‚¬  For purposes of this definition, the term â€Å"behavioral† refers to overt actions; to underlying psychological processes such as cognition, emotion, temperament, and motivation; and to biobehavioral interactions. The general failure of public health to pick up and nurture the more macro social science perspectives to the same degree has limited the full potential of the impact of the social and behavioral sciences on public health, particularly because the historical roots of public health in the latter half of the nineteenth century included a strong social structural viewpoint. Since that time, the theoretical development of economics, political science, sociology, and anthropology has accelerated, but it was often not brought to bear on contemporary public health issues because these issues were often defined in terms of the characteristics of individuals rather than as characteristics  of social structure. The argument is, then, that public health picked up the wrong end of the social science stick—the individual (micro) end rather than the sociocultural ( macro) end. This assertion is supported by any perusal of public health journals or literature on social and behavioral science in public health in the second half of the twentieth century. Nonetheless, as the end of the twentieth century in public health witnessed increasing concern with social concepts such as social inequity, inequality, and community interventions, the disciplines of sociology, anthropology, economics, and political science had a more important role in public health, for the determinants of health were being defined in terms of a social and behavioral perspective. For example, many individual behaviors were recognized as risk factors for poor health, but were also seen as embedded in a wider social context. In addition, a social science–informed healthful public policy was seen by many as a key to the development of public health strategies to improve health. The chief academic disciplines of the behavioral sciences are anthropology, psychology, and sociology, with the distinction between social and behavioral science often blurred when these disciplines are applied in public health research and practice, particularly in schools of public health and governmental agencies. Many, if not most, public health approaches are problem focused and lead to a multidiscipline solution encompassing several social and behavioral science disciplines and combinations of them (such as social psychology), in addition to other public health disciplines such as epidemiology and biostatistics. Anthropology. Anthropology is a broad social science concerned with the study of humans from a social, biological and cultural perspective. Historically it is a Western-based social science with roots in Europe and North America. It includes two broad areas of physical and sociocultural anthropology; both are relevant to public health. Physical anthropology divides into two areas, one related to tracing human evolution and the study of primates, and the other concerned with contemporary human characteristics stemming from the mixture of genetic adaptations and culture. Medical anthropologists with this perspective are often concerned with the relationships between culture, illness, health, and nutrition. Sociocultural anthropology is concerned with broad aspects of the adaptation of humans to their cultures— with social organization, language, ethnographic details, and, in general, the understanding of culturally mitigated patterns of behavior. In recent decades this perspective has taken a more ecologically focused view of the human species. From a public health perspective, this  approach to anthropology is probably most salient in terms of the methodological approaches used by anthropologists. They have a critical concern with understanding communities through participant observation. Indeed, participat ion is probably the key concept linking modern-day anthropological approaches to twentieth-century concepts of public health community interventions. Although the methodology of rapport-based structured interviews and observation is a highly developed methodology among anthropologists, it has had limited application in public health. More recent efforts in public health to address issues of inequity at the community level have created more attention to anthropological approaches. Economics. Economics is perhaps the oldest of the social sciences, with its concern with wealth and poverty, trade and industry. However, current economic thinking generally dates from the last three centuries and is associated with the great names in economic thinking, such as Adam Smith, Robert Malthus, David Ricardo, John Stuart Mill, and Karl Marx. Present-day economics is an advanced study of production, employment, exchange, and consumption driven by sophisticated mathematical models. Basically, the field breaks into two distinctive areas: microeconomics and macroeconomics. Microeconomics is largely concerned with issues such as competitive markets, wage rates, and profit margins. Macroeconomics deals with broader issues, such as national income, employment, and economic systems. The relationship between economics and health is obv ious because in developed countries the percentage of gross national product consumed by the health care industry is significant, generally ranging from 5 to 15 percent of the gross national product. In the poorer countries, the cost of disease to the overall economy can prohibit the sound economic development of the country. In recent years there has been a concern with both the global economic burden of disease as well as with investment in health. That poverty is highly related to poor public health is a widely accepted tenet of modernday thinking in public health. However, economic systems ranging from free enterprise through liberal socialism and communism offer quite differing alternatives to the reduction of poverty and the distribution of economic resources. Psychology. Psychology is probably the most common disciplinary background found in the application of the social and behavioral sciences to public health. Modern psychology is a large field that encompasses physiological psychology,  concerned with the nervous and circulatory systems, as well as social psychology, and concerned with the behavior of individuals as influenced by social stimuli. In general, psychology is concerned with the relationship of living organisms to their environment. In addition to studies focused on physiological mechanisms, psychology is concerned with the broad area of human cognition, including learning, memory, and concept formation. The subfield of abnormal psychology is concerned with mental disorders, ranging from psychoses to neuroses. The subfield of clinical psychology offers direct patient-care mechanisms to treat mental problems in individuals. Thus the application of psychological approaches to health is quite apparent. However, the most salient branch of psychology for public health practice, and particularly for the task of understanding the determinants of health, is probably social psychology. A major focus of social psychology is on attitudes, opinions, and behaviors. Thus, there is an emphasis on understanding how groups and individuals interact with one another. The degree to which many interactions are easy or difficult can play a major role in determining the stability of groups and individuals. Therefore, broad concepts su ch as stress, social cohesion, peer influence, civic trust, and others derive strong theoretical and research support from social psychology. Sociology. Sociology is perhaps the broadest of the social science fields applied to public health. It is also characterized by being eclectic in its borrowing from the other social sciences. Thus, sociology is also concerned with organizations, economics, and political issues, as well as individual behaviors in relation to the broader social milieu. A key concept in sociology, however, is an emphasis on society rather than the individual. The individual is viewed as an actor within a larger social process. This distinguishes the field from psychology. Thus the emphasis is on units of analysis at the collective level such as the family, the group, the neighborhood, the city, the organization, the state, and the world. Sociology is concerned with how the social fabric or social structure is maintained, and how social processes, such as conflict and resolution, relate to the maintenance and change of social structures. A sociologist studies processes that create, maintain, and sustain a social system, such as a health care system in a country. The scientific component of this study w ould be the concern with the processes regulating and shaping the health  care system. Sociology assumes that social structure and social processes are very complex. Definition of organizational behaviour Organizational behavior is a field of study that investigates the impact of individuals, groups and structures upon behavior within an organization. It is an interdisciplinary field that includes sociology, psychology, communication, and management; and it complements the academic studies of organizational theory (which is focused on organizational and intra-organizational topics) and human resource studies (which is more applied and business-oriented). It may also be referred to as organizational science. The field has its roots in industrial and organizational psychology a Organizational studies encompass the study of organizations from multiple viewpoints, methods, and levels of analysis. For instance, one textbook divides these multiple viewpoints into three perspectives: modern, symbolic, and postmodern. Another traditional distinction, present especially in American academia, is between the study of â€Å"micro† organizational behaviour — which refers to individual and group dynamics in an organizational setting — and â€Å"macro† strategic management and organizational theory which studies whole organizations and industries, how they adapt, and the strategies, structures and contingencies that guide them. To this distinction, some scholars have added an interest in â€Å"meso† scale structures – power, culture, and the networks of individuals and i.e. ronit units in organizations — and â€Å"field† level analysis which study how whole populations of organizations interact. Whenever people interact in organizations, many factors come into play. Modern organizational studies attempt to understand and model these factors. Like all modernist social sciences, organizational studies seek to control, predict, and explain. There is some controversy over the ethics of controlling workers’ behavior, as well as the manner in which workers are treated (see Taylor’s scientific management approach compared to the human relations movement of the 1940s). As such, organizational behaviour or OB (and its cousin, Industrial psychology) have at times been accused of being the scientific tool of the powerful.[citation needed] Those accusations notwithstanding, OB can play a major role in organizational development, enhancing organizational performance, as well as individual and group  performance/satisfaction/commitment. One of the main goals of organizational theorists is, according to Simms (1994) â€Å"to revitalize organizational theory and develop a better conceptualization of organizational life.†[2] An organizational theorist should carefully consider levels assumptions being made in theor y,[3] and is concerned to help managers and administrators Behavioral science and organizational behaviour both interrelate and interdepend on each other thou the mean total different things. Chapter3 Finding This study shows that behavioural science does affect organizational behaviour negatively and positively, it could affect one negatively if one had a rough upbringing such as the environment, genetic treats, the person interpersonal relations skill would be poor thus reducing the persons productivity, it can affect positively if one is a good person at heart and is always happy to do the job then the organization may blossom. Recommendation It is highly recommended that managers observe and practice behavioral science amongst his employs so as to balance the organizational behaviour. Chief Executives should encourage behavioral consciousness in their organizations from the top down showing the support and care about ethical behaviour. There is the need for organizations to help their employees in dealings with ethical challenged by adhering to the following steps. [a] Recognize and Clarify the Dilemma. [b] Get all the possible facts [c] List your options, all of them. [d] Test each option by asking: †Is it legal? Is it right? Is it beneficial?† [e] Make your decision. [f] Double check your decision by asking: ‘how would I feel if my family found out about this? How would I feel if my decision was printed in a local newspaper? [g] Implement your action. [h] Make a research and collect feedback on your implementation. [I] Evaluation and control of the whole steps Conclusion It must be emphasized that the challenge of behavioural science must be met by organizations if they are truly concerned about survival uprightness, integrity, and competitiveness. What is needed in today’s complicated times is for more organization to step forward and operate with strong, positive and good organizational behaviours. Organizations must ensure that their employees know how to deal with behavioural issues in their everyday work lives. As a result, when the behavioural climate is clear and positive, everyone will know what is expected of him or her when the inevitable behavioural dilemmas occur. Monads are established as the most simple substance of which there are no parts or extensions (paragraphs 1 and 2). In paragraph 6 "monads have no windows" and hence are self-existing in a way. Leibnitz must explain what he means. Monads are different from each other because it is impossible for there to be the same thing in nature or else one thing would not be "discernible form another", things or monads must have an "internal difference" (p. 9). These differences are created from internal causes (p. 11). It is these internal causes which can make something that is itself, different or cause it to change and appear different. We are aware of our perceptions of these things, or of the thing that is undergoing change. Descartes was mistaken not to treat perception as a way of giving us what a thing and its changes are. Hence Descartes was left with the mind and or consciousness standing by itself. Leibnitz explains that perception represents "a multiplicity in the unit" of the simple substance. This is his way of saying that the mind cannot be separated from consciousness of the body. At paragraph 17, Leibnitz says that "...perception and that which depends upon it are inexplicable on mechanical grounds." That which recognizes substance and its various attributes cannot be based on the "figures and motions", or logic. Leibnitz in 15 has explained that it is Appetition or desire which is able to move from one perception to its wholeness or to new perceptions. If one were to move from the mind to the body, it would take not mere thought, but "Appetition or desire" to place these two together as a collective unit. Monads, as simple substances, are immaterial and have no extension. Yet they have their own perspective and something gives them extension and purpose. They have a certain self-sufficiency based on their internal activities. In paragraph 19 Leibnitz says tha t perception could allow simple substances to have souls, but that this is not possible unless perception is accompanied by memory. Mind gives monads or simple substances extension, purpose and identity. Whereas Descartes would say there is mind without body, Liebnitz would argue that there can be no mind without body. Mind and body are both monads, but the point is that it is the mind which is able to recognize the perception of the body or a rock outside the body with extension and secondary qualities such as color and taste. Humans are able to think empirically, such that there will be "daylight tomorrow." This is evidence the rational ability that humans have, and the knowledge of necessary and eternal truths that give us Reason and distinguishes us from animals (p. 29). Truth derives from the two great principles of contradiction (p. 31), and of sufficient reason (p. 32). These both refer to the two kinds of truths, reasoning is based on the principle of contradiction, and deal s with necessary truths that are found by analysis, such as in mathematics. The principle of sufficient reason allows for contingent truths, or truths based on fact (p. 36). The character of Hamlet is a key figure who plays a central role amongst the three parental relationships he is a part of. These relationships give rise to issues of obedience and parental responsibilities. Denmark being a Christian country, expects its countrymen to follow the guidelines of the religion. One of the Ten Commandments states that one must honour thy mother and father. Hamlet becomes increasingly rude towards his mother because of her recent marriage to his uncle Claudius, and openly states that she is her husbands brothers wife (14;4;3). According to the laws at the time, as stated in The Book of Common Prayer, to marry ones brother in law was forbidden. The audience echo Hamlets moral outrage but he comes to passionately loathe his mother, disgusted at her incestuous desires. Hamlets disgust erupts at the fact that his mother re-married but two months after his fathers death. As a loyal and loving son to his father, Hamlet is devastatingly crushed that his mother could so quickly and easily replace the man in both their lives he loves and respects with an undying awe. This leads Hamlet to regard his mother as a pernicious woman showing that he believes her to be joyful of her husbands death. His language amplifies a sense of assonance, sounding the hiss of a snake. A snake is considered to be a dangerous, life-threatening creature associated with agility and evil. The cold blooded reptile might be an image Hamlet associates with his mother, who he feels swiftly and cunningly conspired to murder his beloved father with a malevolent nature, rendering her incapable of any kind of remorse. Hamlet arrives to a point of such hatred that he cannot bear even to have any relation to his mother. For him would it were not so, you are my mother (15;4;3) showing that he destroys the filial bond of mother and son. His language reflects a deep and profound sorrow for which he must hold his heart, causing his feelings to be repressed. As a result Hamlet believes that he was born to set it right suggesting his eagerness for revenge. It shows that Hamlet believes it is his filial duty, which he intends to complete with utmost loyalty. Hamlet idolises his father finding no wrong whatsoever in him despite Denmark having died with all my imperfections on my head. The ghost is a representation of Denmarks uncompleted life in the sense that he died without confessing his sins. This suggests that the ghost is suffering a great deal of pain and stress, which Hamlet indubitably suffers from too. The fact that his father died this way generates more sympathy from Hamlet and therefore adds to his craving for retribution. His sinful vengeance accumulates allowing his violence to be expelled through the murdering of Polonius, yet another sin. One parental duty is to watch over your child, protecting them from harm. Voyeuristically, Polonius watches Hamlet, in an effort to be whiteness to any inappropriate behaviour, so that he can protect his daughter from Hamlet. However, Hamlet sights a rat who he kills without any consideration. Hamlet displays an immense amount of disrespect to Polonius, who is a potential father in law to him. This then allows the audience to see Hamlets unshaken dedication to his father. Polonius covert presence gives a tangible sensation of claustrophobia. This reflects the suffocation Hamlet suffers from due to the many combined parental figures that exist in his past and present. Shakespeare would stage the play with the use of many soldiers to intensify the claustrophobia. Despite its added cost, it helped to create a sense of unease amongst the audience who then could relate to the way Hamlet felt trapped for I must hold my tongue. Although, at one stage he Draws his sword, and very nearly completes his vendetta, but decides against it, not wanting to do this same villain send to heaven, due to Claudius confessing his sins at this point. Hamlets sexual desires for his mother can also be interpreted from the immense jealousy he has for his uncle. Hamlet craves his uncles death for murdering his father and taking his crown, but surreptitiously for sleeping with his mother. Furthermore Hamlet displays a great sense of misogyny in appearing to loathe his mother. He believes she is subject to frailty implying that she is weak for giving in to her sexual desires for Claudius. The irony, however, is that Hamlets frustration is rooted in the inability he suffers from, to admit his own incestuous weakness. So much so is his frustration that the ghost of Denmark must remind him to leave her to heaven (86;5;1) and being that more than once, this indicates an intense abhorrence for his mother. With this in mind, it is therefore debateable as to who Hamlet is more enraged with Gertrude or Claudius? In a natural order, children are obedient and loving towards their parents. Hamlet however detests his mother and dishonours her while at the same time, sinfully desires her sexually. This reflects the disorder of the whole play, much of which is related to the disorder in parental relationships. Hamlet calls Claudius his Uncle Father which is sarcastic yet uncertain and leaves Hamlet confused. His sarcasm is disrespectful and dishonourable towards Claudius as he is acting as Hamlets father. This trend represented a huge threat to regional and global stability as the spillover effect of these internal conflicts witnessed mass deaths and refugee movements across borders. The search for succor to this fiasco beamed a search light towards liberal peace building which aims to prevent a recurring violence and enduring long lasting peace in post conflict environments. The liberal peace paradigm is therefore predicated on a fundamental essence of establishing stability in post conflict societies through a prevailing peace building consciousness. As a post-mortem approach to conflict circumstances, liberal peace seeks to lay the foundation for long term stability through strengthened democracy and open market economics embedded in a framework for international peace. However, the historical experiment of the liberal peace model has been consequentially fratricidal especially in fragile and divided societies just emerging from civil war (Paris 2004, p.151). It therefore puzzles some commentators that the liberal peace model translates into a world view of a benevolent concept, which seeks to consolidate peace through concrete strategies of establishing socio-economic foundations juxtaposed with solid political framework for long term sustainable peace. This gap between the normative liberal peace concept and the empirical evidence obtained, paves way for criticism. This essay therefore seeks to inquire the conduct of liberal peace operations in post conflict societies by engaging existing debates that questions the practical consequences of the liberal peace project as evident in post civil war societies. Therefore the essay will be divided into four parts, the first part delves into the discursive debates of liberal peace, with a view to understanding the ideological choice of the subject matter. The second part looks at the empirical illustration that touches upon international institutions involvement in promoting liberal peace particularly in non advanced democracies and closed market societies around the world, this will help clarify and validate the inherent tensions in international peace building proposals. The thirdly part will underscore some of the challenges in establishing liberal peace, while the paper concludes by giving plausible recommendations as to how best the liberal peace model can be established without necessarily generating skepticism on its long term strategy towards a feasible world order. I find solace in the contention that liberal peace continuous to offer a more comprehensive international policy frame work for global peace, based on the assumptions that liberal market democracies rarely engage in violent war (Doyle 1986, P.1151). Liberal peace has therefore been conceived to be a western consensus to pioneer a global shift towards political and economic reform. In almost all parts of the world, liberal peace became â€Å"something close to a global theology† in post cold war era (Ake 1997, p.287). As a remedy for conflict prevention, multi-nationals also played roles of peace building agent through the promotion of good governance in developing countries. In today`s global politics, liberal peace has been transformed into a new interventionist norm within international security framework guided by a widely held assumption of conflict management theory (Chandler 2004, p.59). Interestingly, the principles that necessitated peace building experiments particularly at post civil conflict situations have attracted the attention of keen observers. Since there are no indications that peace building operations will be on the decline owing to `currency new wars`, in today`s international domain. The liberal peace debate does offer an opportunity to vigorously investigate into the prevailing conduct of peace building operations with a view to establishing effective strategies that suits the task of lasting peace in domestic post conflict environment and the world in a broader sense. The end of the cold war marked a water-shed in the promotion of liberal peace building across nation states. The United Nation and other international organizations became directly involved in several measures to proffer lasting peace on long-standing conflicts. During this period international organizations were willing to put in energies and resources in rehabilitating ‘failed states, as such the United Nations became increasingly proactive in cases of humanitarian crises on a large scale. Consequently, new peace building missions were launched by the United Nations Security Council to cope with the cases of civil conflicts that preceded the cold war. However, it is of interest to note that the pattern of peace building during this period was observed to have shifted beyond the traditional peace keeping in Westphalia sense. For instance in Cambodia the UN transitional authority (UNTAC) through its mandate temporarily took over administration of the domestic affairs (Schear 1996, p.174). The peace building manifestations saw UNTAC through an election and in that sense it was applauded for fostering peace through political liberalization, although the long term legacy of democratization in Cambodia showed that the elections brought relative calm to Cambodia during the election, but soon after the United Nation withdrew UNTAC the status quo returned. UNTAC, whose mandate was leveraged on a robust peace agreement between the warring groups in Cambodia, operated within the liberal peace building framework. The peace agreement was in principle a master plan to bring lasting peace to Cambodians through drafting a new constitution to accommodate the entrenchment of liberal democracy and a committed human rights declaration. This approach assumes that transforming Cambodia from a troubled state, to a liberal democratic one will move the country from its â€Å"far civil† situation to a peaceful political atmosphere. Indeed this prescription is what the liberal peace model identifies with in principle. In practice however, UNTAC penetrated the Cambodian local administrative network and in so doing lured Cambodia into adopting a market-disposed economic reform. These matrix of a liberal market democracy saw UNTAC accomplishing a transition process within six months to scheduled elections in Cambodia by may 1993 (Prasso 1995, P,39). By implication a thorough demobilization of belligerents which, was crucial to both an immediate peaceful electoral environment and after was hastily carried out. Not astonishing however a catastrophic political wave rocked Cambodia again four years later, the outbreak of violence was majorly between two contending political party FUNCINPEC and CPP preparatory to an election. It is however necessary to note that, the democratization of Cambodia was not by implication a solely destabilizing factor responsible for an awakened violence in Cambodia, nevertheless democratization cause an unhealthy political competition that ignited the new fight leading up to the 1998 elections. In other words, as a long term strategy for long standing peace UNTAC could have consolidated on the accomplished elections through erecting liberal structures that can manage and implement the rule of law, human right declaration, civil liberty and individual freedom in Cambodia. Also, liberal peace has been held accountable in explaining the ideological assumptions that created policies leading to the invasion in Iraq. Although liberalism was not exclusively the policy agenda that nurtured the United States invasion of Iraq in March 2003, the invasion finds origin on the need to spread liberty and uphold individual freedom. As the president of the United States at the time did say on the eve to the invasion, â€Å"A new regime in Iraq would serve as a dramatic and inspiring example of freedom for other nations in the region† (Bush 2003) he meant by this statement that, establishing democratic norm all over the middle east was crucial to freedom in the region. On this note, the philosophical premise upon which the United States invaded and occupied Iraq in 2003 can also be linked to neo-conservatism (Owen 2007, p 266). But more clearly neo-liberalism best prescribes the long term development strategy in which the invaders use to defend their actions. Since the liberal ideology does embrace the socio-political and economic gains of capitalism, the United States interprets invasion as pursuant to its commitment for improved human liberty by delivering freedom to all states in the international syst em, in the assumption that if nations and societies are free to choose their political and economic liberty there is a likelihood for international peace and stability It can therefore be pointed out that liberal peace influenced the policy of the United States in a strategic long term sense. The quest for regime change and individual freedom by the United States was based on the suspicion that the state poses a threat in enabling its citizens to exercise their free will. The corollary of which the United States as a progressive world body and a promoter of virtuous government (Williams 2005, p.318) invaded in the interest of international peace and stability. Although it is significant to mention that the Iraq circumstances is indeed unique, in the sense that efforts to rebuild Iraq was not born out of a post civil war experience. Rather the need to rebuild Iraq was an aftermath consequence of foreign invasion. Perhaps the inference of Iraq here is to show the desire to establish material economic prosperity and democratic value just after the invasion. Arguably the lessons from Iraq, does not necessarily fit into the general nature of peace building in internally generated conflicts, it bears similar challenges that actual civil war reconstruction pioneered by liberal peace philosophy face. The challenges of contemporary liberal peace: The records of entrenching liberal peace have continued to be flawed with failures. The costs of failure have been phenomenal both to the immediate society where the conflict is present and the international community in general. It is therefore in this context that we are keen to ascertain the obstructing factors towards the construction of lasting peace through liberal peace objectives. Suffice to mention at this juncture that the `right of humanitarian intervention` deployed by liberal states to protect individual rights internationally has given rise to a legitimacy question. In a bid to safeguard individual rights, the liberals justify intervention in humanitarian terms; they claim that even though the framework for intervention is not clearly embedded in the UN charter, the new consciousness for international peace makes intervention morally legitimate. This view is been refuted by the realist`s school as they continually stress that the international norm for peace is anchored on state oriented collective security agenda of the United Nations. Therefore, the incompatibility of `state sovereignty` to cope with the new interventionist norm of liberal peace, constitutes a fundamental challenge which undermines the progress of liberal peace. Hence the challenges of liberal peace will be described under the following headings:- Humanitarian Intervention:- The concept of humanitarian intervention has been problematic in erecting liberal peace architecture internationally. Since liberal peace often attempts to create the framework for international order via interventions, the moral defense in todays anarchical world is hard to find. Efforts to legitimize intervention, for human security purpose culminated in the constitution of an Independent Commission on Intervention and State Sovereignty (ICISS). The commission was mandated to resolve the moral friction between `intervention and sovereignty` in a desire to evolve a holistic agreement on how to shift from debates towards action. Nonetheless the commission argued that Intervention remains a moral and ethical issue, noting that the universal declaration of human rights is a tool for alienating individual rights based on normative liberal claims. This implies that the onus is morally on the state as a `moral agent` to protect the rights of its citizenry, except in cases where such rights are being abused, external intervention can be excused based on consent. The absence of consent triggered the dilemma on the United Nations involvement in Iraq; perhaps if authorization and endorsement were sought the crisis of legitimacy would not have arisen. In this circumstance, liberal peace suffers from internationalizing the `right of intervention`, as the primary `responsibility to protect` beckons on the state concerned. The Intervening power of the international community should be exercised where an unprecedented lack of the state willingness to manage its sovereignty is manifest. Activities on non state actors:- The activities of non-state actor in some internationally sponsored peace building arrangement may point to a very crucial factor against the success of liberal peace. Since contemporary civil conflict has become large scaled, it practically becomes impossible for the United Nations to solely combat or manage conflict across different locations. Thus, non-state actors get involved in the spread of liberal peace through peace building missions. However it can be argued that this exercise, impacts on an un-even spread of democratic principles, this could be the case when some multi-national firms for instance will assist in establishing liberal peace norms where they operate, partly because the eruption of war disrupts their economic activities. At the instance of institutionalizing before liberalizing, the success of peace building missions would be anchored on the construction of viable institutional settings capable of absorbing the pressure of elections especially where the contestants and voters alike are just emerging from conflict. More so a functional institution will require the ability to enforce constitutional doctrines with an independent judicial mechanism prior to elections, therefore the idea of institution building ultimately seeks to ensure that transition towards democracy is prolonged in a manner that prepares war shattered states to be ripe for election (Paris 2004. In sum, the aim of Wilsonian peace building strategy (liberal peace) is not irrelevant in its entirety; rather the broad goal of a peaceful international system has been undermined due to a twist in recent practice. Since democracy which liberal peace advocates, fosters a social contract upon which socio-economic and political tensions that threaten the stability of societies and states can be managed. The institutionalize before liberalize campaign will aid in the dissemination of a less faulty democratization and marketization formula for long term peace in post civil war states around the world.
